Consumer Awarded $5.5 Million in Damages for Unfair Term - The provider of a trading platform was held to a mistake that led to a user making a profit of $5.5 million, despite a term in its standard form contract that sought to void or amend terms of transactions based on errors. Injunction Granted to Prevent Serious Invasions of Privacy - In the first case of its kind in Australia under new privacy laws, a Court has stopped someone from invading the privacy of another person. Whilst to date most of the attention regarding serious invasions of privacy has focused on journalism and media reporting, this case shows that a serious invasion of privacy can occur in very different contexts. These include data breaches, surveillance and investigations, social media, employment, services including financial services, advertising/ marketing, domestic relationships, property and nuisances and breaches of confidentiality.
