Elizabeth provides practical, tailored and effective workplace strategies to public and private sector employers across all industries. She also acts for clients in a wide range of workplace disputes before State and Federal Courts and industrial tribunals.

EXPERIENCE & EXPERTISE

For 20 years Elizabeth has specialised in all aspects of workplace law, including industrial and employment relations, work health and safety, and anti-discrimination.

Elizabeth works closely with her employer clients’ human resources and legal teams, as well as executive management and Board members, to provide advice on workplace strategy, and responses to industrial disputes and safety issues when they arise.

Her workplace and industrial advisory work includes: assisting with award interpretation; preparing and implementing contracts of employment and workplace policies; managing workplace performance, disciplinary procedures and termination of employment; developing risk management and industrial relations strategies, including in the resolution of industrial disputes and workplace grievances; advising on enterprise bargaining, enterprise agreement drafting, and approval applications; and developing and delivering workplace training programs.

In work health and safety matters, Elizabeth provides: advice on rights and obligations during SafeWork investigations, including in response to incidents involving serious injuries and workplace fatalities; assistance with workplace safety compliance and policies; and facilitated training for executive teams and Board members on their due diligence duties under safety legislation.

Elizabeth also represents employers in all employment-related litigation including the defence of claims alleging unfair dismissal, unlawful termination, adverse action, breach of contract, unlawful discrimination and workplace bullying, as well as in the defence of work health and safety prosecutions.

She regularly appears before the Fair Work Commission, the Federal Court of Australia, the Industrial Relations Commission of NSW, the NSW Anti-Discrimination Board, the NSW Civil and Administrative Tribunal and the Australian Human Rights Commission.

Admitted to practice in New South Wales, Victoria and the High Court of Australia, Elizabeth joined Moray & Agnew in 2011.

Elizabeth builds long-lasting, close working relationships with her employer clients, who recognise the industry insight and commercial understanding she brings to her role as adviser and advocate. Elizabeth’s client’s value her accessibility and frequently seek out her ‘sounding-board’ advice on day-to-day compliance matters as well as emerging complex issues, allowing for the early resolution of many matters which might otherwise escalate and lead to litigation.

ACCOMPLISHMENTS

Elizabeth has assisted many of her construction, manufacturing and local government clients avoid protracted and costly industrial disputes by providing proactive strategies for workplace engagement and negotiations with employees and union representatives, including during enterprise bargaining.


Elizabeth has also assisted numerous employers in response to regulatory enquiries and investigations following workplace safety incidents, frequently avoiding prosecution proceedings.
