Caitlin’s principal area of practice is acting for insurers and trustees of superannuation funds in relation to total and permanent disablement claims, income protection and death claims. She is also experienced in assisting clients to defend disputes made through the Australian Financial Complaints Authority (AFCA) as well as providing strategic pre-litigation advice relating to assessment and management of life and disability claims.
Other experience includes a secondment with one of Australia’s pre-eminent life insurers, where she assisted both retail and group claims teams by providing advice and support.
Caitlin’s approach to her work focuses on obtaining timely, commercial outcomes for her clients.
Caitlin has acted in numerous income protection and total and permanent disablement claims which deal with the avoidance or variation of cover provided under s29 of the Insurance Contracts Act 1984 (Cth), as well as preparing detailed advice and review of claims in relation to prospects of success, strength of evidence and the credibility of insureds.
During her secondment with one of Australia’s pre-eminent life insurers, Caitlin advised on complex policy interpretation issues as well as procedural fairness and decision letters. She also drafted detailed submissions to (the former) Financial Ombudsman Service.
Caitlin also has experience in handling public liability claims, including assisting to defend a class action arising from a bush fire in Victoria. In this case, she assisted to obtain a positive outcome for her client as a result of her proactive reviewing of the evidence and preparing the matter for mediation ahead of trial.
